Welcome to ALZATA Shops. The terms “we,” “us,” and “our” refer to ALZATA Shops.

ALZATA Shops operates this online store and website, including the related information, content, features, tools, products, and services offered through the website (collectively, the “Services”). ALZATA Shops is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with any policies referenced herein, describe your rights and responsibilities when accessing or using the Services.

Please read these Terms carefully. They contain important information regarding your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, purchasing from, or otherwise using our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms or our Privacy Policy, please do not access or use the Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you are the age of majority and have given permission for your minor dependents to use the Services on devices you own, purchase, or manage.

To use certain Services or purchase products, you may be asked to provide information including your name, email address, billing information, payment information, and shipping information.

You represent that information provided to ALZATA Shops is accurate, current, and complete and that you have the right to provide such information.

You are responsible for maintaining the security of your account credentials and for activity conducted through your account.

You may not transfer, sell, assign, or license your customer account to another person.

SECTION 2 – PRODUCTS AND PRODUCT INFORMATION

ALZATA Shops makes reasonable efforts to provide accurate product descriptions, photographs, measurements, colors, sizing information, and other product information.

However, product colors and appearance may vary depending on your device, monitor, screen settings, lighting, photography, manufacturing processes, and other factors.

Because ALZATA Shops offers merchandise from multiple brands, manufacturers, and fulfillment sources, sizing and fit may vary between products.

Customers are responsible for reviewing the size chart, measurements, product description, color selection, and other information provided on the applicable product page before placing an order.

Product images are intended to provide a reasonable representation of the merchandise. Minor variations in color, texture, placement, measurements, or appearance may occur where appropriate to the product or manufacturing process.

Product descriptions, availability, pricing, and specifications may be changed without notice.

We reserve the right to discontinue products or limit quantities offered to any person, geographic region, or jurisdiction where permitted by law.

SECTION 3 – THIRD-PARTY FULFILLMENT AND PRINT-ON-DEMAND PRODUCTS

ALZATA Shops works with third-party fulfillment partners to manufacture, store, process, fulfill, and/or ship certain merchandise on our behalf.

As a result, products within the same order may be processed or shipped from different fulfillment locations and may arrive in separate packages.

Certain merchandise is produced on a print-on-demand (“POD”) basis after an order is placed.

POD merchandise is subject to the additional conditions described in our Refund & Return Policy. All POD merchandise is final sale except for qualifying damaged, defective, incorrect, or misprinted merchandise as described in that policy and as otherwise required by applicable law.

Your purchase is made from ALZATA Shops. Questions concerning an ALZATA Shops order should be directed to us at admin@alzatashops.com.

SECTION 4 – ORDERS

When you submit an order, you are making an offer to purchase the products contained in that order.

ALZATA Shops reserves the right, where permitted by law, to accept, decline, limit, or cancel an order, including because of product availability, suspected fraud, payment issues, pricing or listing errors, fulfillment limitations, or other legitimate business reasons.

Your payment must be authorized and processed before your order can be fulfilled.

Please review your order carefully before submitting it, including the products, sizes, colors, quantities, personalization information, billing information, and shipping address.

If we decline, modify, or cancel an order after it is submitted, we will attempt to notify you using the contact information associated with the order.

Purchases are subject to our Refund & Return Policy and Shipping Policy.

Products purchased through ALZATA Shops are intended for personal or household use unless otherwise expressly authorized.

SECTION 5 – ORDER CANCELLATIONS

If you need to request cancellation of an order, contact admin@alzatashops.com as soon as possible.

An order may only be canceled before it enters processing or fulfillment.

Because orders may enter processing shortly after being placed, submitting a cancellation request does not guarantee that the order can be canceled.

Once an order has entered processing, fulfillment, or shipment, it cannot be canceled.

SECTION 6 – PRICES, BILLING, AND PAYMENT

Prices, discounts, promotions, and product availability are subject to change without notice.

The price charged for a product will generally be the price displayed at the time the order is submitted, subject to correction of pricing or listing errors as permitted by applicable law.

Applicable shipping charges and taxes will be displayed or calculated during checkout when applicable.

You agree to provide current, complete, and accurate purchase, payment, billing, shipping, and account information.

You represent that you are authorized to use the payment method submitted for your purchase.

ALZATA Shops may offer promotions, discounts, coupon codes, or other special offers from time to time. Such promotions may be subject to additional terms, eligibility requirements, expiration dates, product exclusions, or other restrictions.

If promotional terms conflict with these Terms regarding the specific promotion, the promotional terms will control to the extent of that conflict.

SECTION 7 – SHIPPING AND DELIVERY

ALZATA Shops currently offers shipping to eligible destinations within the United States, eligible U.S. territories, eligible APO/FPO and military addresses, and Canada, subject to product, carrier, and fulfillment availability.

Shipping destinations may be changed or expanded in the future.

Processing and delivery estimates are estimates only unless expressly identified as guaranteed.

Delivery may be affected by carrier delays, severe weather, holidays, customs processing, transportation disruptions, governmental actions, fulfillment delays, and other circumstances outside our reasonable control.

Orders containing multiple products may arrive in separate shipments and may have separate tracking numbers.

Customers are responsible for providing complete and accurate shipping information.

Canadian orders may be subject to customs processing, duties, taxes, brokerage charges, or other government- or carrier-imposed charges as described in our Shipping Policy.

SECTION 8 – RETURNS, REFUNDS, AND EXCHANGES

Returns and refunds are governed by our Refund & Return Policy.

Eligible return requests for qualifying standard merchandise must be submitted within 14 calendar days of delivery.

ALZATA Shops does not offer exchanges.

ALZATA Shops does not accept returns solely because of change of mind or buyer’s remorse, subject to rights that cannot be waived under applicable consumer-protection law.

Customers are generally responsible for return-shipping costs for approved returns unless ALZATA Shops or one of our fulfillment partners sent an incorrect, damaged, or defective product.

Original shipping charges are generally nonrefundable except as otherwise stated in our Refund & Return Policy or required by law.

All print-on-demand products are final sale except qualifying damaged, defective, incorrect, or misprinted merchandise. Qualifying POD claims must be reported within 30 calendar days of delivery, as further described in our Refund & Return Policy.

Customers must contact ALZATA Shops for authorization and instructions before mailing merchandise for return.

SECTION 9 – INTELLECTUAL PROPERTY

The Services, including trademarks, trade names, logos, branding, text, graphics, photographs, product reviews, videos, audio, designs, website content, and the selection and arrangement thereof, may be owned by ALZATA Shops, its affiliates, licensors, suppliers, or other applicable rights holders and may be protected by U.S. and international intellectual-property laws.

These Terms permit you to use the Services for personal, non-commercial purposes only.

Except where expressly permitted, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, sell, or transmit protected materials from the Services without authorization from the applicable rights holder.

Nothing in these Terms grants you ownership of or a license to ALZATA Shops trademarks, branding, intellectual property, or other protected content except as expressly provided.

ALZATA Shops names, logos, designs, product names, service names, and slogans owned by ALZATA Shops may not be used without authorization.

Shopify's trademarks and intellectual property belong to Shopify or its applicable rights holders.

All other trademarks belong to their respective owners.

SECTION 10 – OPTIONAL TOOLS AND THIRD-PARTY SERVICES

The Services may provide access to tools, applications, payment services, integrations, or other functionality offered by third parties.

We may not monitor or control all such third-party tools.

Third-party tools may be provided “as is” and “as available,” subject to the terms and policies of their respective providers.

Your use of third-party tools is subject to the applicable provider's terms and policies.

We may add new features, integrations, tools, or resources to the Services in the future. Such features will also be considered part of the Services where applicable.

SECTION 11 – THIRD-PARTY LINKS

The Services may contain links to websites, services, or online platforms operated by third parties.

ALZATA Shops is not responsible for the content, accuracy, availability, security, privacy practices, or other practices of third-party websites that we do not control.

If you leave our Services to access a third-party website or service, you do so subject to that third party's applicable terms and policies.

Please review third-party policies before providing information or completing transactions through third-party websites.

SECTION 12 – RELATIONSHIP WITH SHOPIFY

ALZATA Shops is powered by Shopify, which enables us to provide the Services to you.

However, sales and purchases made through our store are transactions directly between you and ALZATA Shops.

By using the Services, you acknowledge that Shopify is not the seller of products purchased from ALZATA Shops and is not responsible for the sales transaction between you and ALZATA Shops.

To the extent permitted by applicable law, Shopify and its affiliates are not responsible for injury, damage, loss, claims, or liabilities arising from products purchased directly from ALZATA Shops.

SECTION 13 – PRIVACY

Personal information collected through the Services is handled according to our Privacy Policy.

Because our store is powered by Shopify, Shopify may collect and process personal information relating to your access to and use of the Services in order to provide and improve Shopify's services.

Information may also be shared with service providers, payment processors, fulfillment partners, shipping carriers, marketing partners, and other third parties when necessary to operate our business, fulfill orders, provide the Services, or as otherwise described in our Privacy Policy.

SECTION 14 – CUSTOMER REVIEWS, FEEDBACK, AND USER-GENERATED CONTENT

If you submit product reviews, photographs, comments, ideas, suggestions, feedback, or other content (“Feedback”) through or regarding the Services, you represent that you have the right to submit such content.

Subject to applicable law and our Privacy Policy, you grant ALZATA Shops a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, distribute, display, and otherwise use Feedback for purposes related to operating, improving, marketing, and promoting the Services and ALZATA Shops.

You are responsible for ensuring that your Feedback does not violate another person's intellectual-property, privacy, publicity, contractual, or other legal rights.

Feedback must not contain unlawful, defamatory, abusive, obscene, fraudulent, malicious, or otherwise prohibited content.

We may monitor, edit, decline, or remove Feedback where permitted by law, but are not obligated to do so.

SECTION 15 – ERRORS, INACCURACIES, AND OMISSIONS

Occasionally, information available through the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, photographs, pricing, promotions, availability, shipping charges, processing times, transit times, or other information.

Where permitted by applicable law, we reserve the right to correct errors, inaccuracies, or omissions and to update information.

If an error materially affects an order you have already placed, we may contact you regarding available options, including correction or cancellation where appropriate.

SECTION 16 – PROHIBITED USES

You may access and use the Services only for lawful purposes.

You may not use the Services to:

• Violate applicable laws or regulations;
• Infringe the intellectual-property or other legal rights of ALZATA Shops or another person;
• Submit fraudulent, false, or misleading information;
• Harass, abuse, threaten, defame, or unlawfully discriminate against another person;
• Upload or transmit viruses, malicious code, or other harmful technology;
• Spam, phish, scrape, crawl, or improperly collect information;
• Attempt to circumvent security features;
• Interfere with the operation or security of the Services;
• Impersonate another person or entity;
• Conduct fraudulent transactions; or
• Engage in other conduct that unlawfully harms ALZATA Shops, Shopify, our customers, or third parties.

We reserve the right to restrict, suspend, or terminate access to the Services when we reasonably determine that these Terms have been violated.

We may suspend or terminate access to the Services where permitted by law, including when we determine that a user has violated these Terms.

Termination does not eliminate obligations or liabilities that arose before termination.

Provisions that by their nature should survive termination will continue to apply, including provisions relating to intellectual property, liability, indemnification, governing law, and other applicable provisions.

While ALZATA Shops makes reasonable efforts to provide accurate information, we do not warrant that all information available through the Services will always be complete, accurate, current, or error-free.

EXCEPT AS EXPRESSLY PROVIDED BY ALZATA SHOPS OR REQUIRED BY APPLICABLE LAW, THE SERVICES AND PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, DURABILITY, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT ACCESS TO THE SERVICES WILL ALWAYS BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

SOME JURISDICTIONS DO NOT PERMIT CERTAIN WARRANTY DISCLAIMERS. NOTHING IN THESE TERMS EXCLUDES WARRANTIES OR CONSUMER RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.

SECTION 19 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALZATA SHOPS AND ITS AFFILIATES, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR SIMILAR DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.

THE FOREGOING LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

NOTHING IN THESE TERMS IS INTENDED TO EXCLUDE OR LIMIT LIABILITY OR CONSUMER RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

SECTION 20 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless ALZATA Shops and its affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, and reasonable legal expenses arising from:

1. Your material breach of these Terms;
2. Your violation of applicable law or the rights of a third party; or
3. Your unlawful or unauthorized use of the Services.

Nothing in this provision creates an obligation prohibited by applicable law.

SECTION 21 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, void, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law and, where necessary, severed from these Terms.

The remaining provisions will remain in effect.

SECTION 22 – WAIVER AND ENTIRE AGREEMENT

Failure by ALZATA Shops to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

These Terms, together with the Privacy Policy, Refund & Return Policy, Shipping Policy, and other policies or terms expressly incorporated by reference, constitute the agreement governing your use of the Services to the extent applicable.

SECTION 23 – ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent where such restriction is permitted by law.

ALZATA Shops may transfer or assign its rights and obligations in connection with a merger, acquisition, sale, restructuring, or other legitimate business transaction, subject to applicable law.

SECTION 24 – GOVERNING LAW

These Terms and any separate agreements through which ALZATA Shops provides Services will be governed by applicable laws of the jurisdiction in which ALZATA Shops is headquartered, without depriving consumers of protections that cannot be waived under the laws applicable to them.

Any governing-law or jurisdiction provision contained in these Terms applies only to the extent permitted by applicable law.

We may update these Terms periodically to reflect changes to our Services, business practices, policies, technology, or legal and regulatory requirements.

The most current version will be posted on this page.

When required by applicable law, we will provide appropriate notice of material changes.
